Media Licensing Policy

This Media Licensing Policy ("Policy") governs the use of all photographs, videos, and media assets created through services booked on the Visual Advantage Media platform ("Platform").

This Policy applies to all users of the Platform including:

• real estate agents
• brokerages
• photographers
• editors
• enterprise users

This Policy is incorporated by reference into the Visual Advantage Media Terms of Service.

1. Ownership of Media

All photographs, videos, and media assets created through services booked on the Visual Advantage Media marketplace are considered works made for hire under U.S. copyright law.

To the extent any media is not considered work-for-hire, the photographer irrevocably assigns all rights, title, and interest in the media to Visual Advantage Media LLC.

Visual Advantage Media LLC is the sole owner of the copyright in all marketplace media created through the Platform.

2. Client License

Upon full payment of a booking, the Client receives a perpetual, non-exclusive license to use the delivered media assets for the purpose of marketing the specific property associated with the booking.

Permitted uses include:

• MLS listings
• real estate marketing materials
• brokerage websites
• social media marketing
• print advertising for the listing

This license is granted only to the original purchasing agent, brokerage, or property owner associated with the listing.

The license does not grant ownership of the media.

3. Listing Transfer License

If the property listing transfers to a different real estate agent, brokerage, property manager, developer, or marketing entity, the original license does not automatically transfer.

The new listing agent or brokerage must obtain a new license through the Platform in order to legally use the media assets.

Visual Advantage Media may offer listing transfer licensing at its discretion.

Unauthorized reuse of media assets by a different listing agent or brokerage may constitute copyright infringement.

4. MLS Reuse Restrictions

Media assets licensed for a property listing may not be reused for:

• a new MLS listing after expiration
• a relisting of the same property under a different agent
• marketing a different property

unless a new license is obtained through the Platform.

5. Prohibited Uses

Clients may not:

• sell media assets to third parties
• sublicense media assets
• license media to builders, developers, or staging companies
• use media for unrelated commercial marketing
• submit media to stock photography libraries

without written permission from Visual Advantage Media.

6. Commercial Licensing

Organizations wishing to use media assets for purposes beyond property listing marketing may request a commercial license from Visual Advantage Media.

Examples include:

• builder marketing
• architectural publications
• commercial real estate marketing
• advertising campaigns

Commercial licensing fees may apply.

7. Photographer Portfolio License

Photographers who capture images through the Platform are granted a perpetual, non-exclusive, royalty-free license to use the media they captured solely for self-promotional purposes.

Permitted uses include:

• personal portfolios
• websites
• social media
• marketing materials

Photographers may not sell, license, or commercially distribute such media without written permission from Visual Advantage Media.

8. Platform Marketing Rights

Visual Advantage Media may use any media created through the Platform for purposes including:

• marketing and advertising
• promotional materials
• portfolio displays
• product demonstrations

This use does not require additional permission from photographers or clients.

9. Unauthorized Use

Unauthorized use of media assets may result in:

• revocation of licensing rights
• additional licensing fees
• removal requests
• legal enforcement

Visual Advantage Media reserves the right to enforce its intellectual property rights to the fullest extent permitted by law.
